13-11-2007 RG: "Draft Bill" Was Sent to State Duma
So the government has decided to impose state control over activity of private detectives. The idea of such a bill has emerged as, as the ones presenting the draft explain, activities of more than 27 thousand private security-detective structures "are directly linked to limiting constitutional rights of citizens as well as with turnover of weapons and special facilities, influencing state of law and order and the state security". In general, they took care of citizens of Russia as they could.
The draft bill comes in spite of the fact that a year ago the Head of the Ministry of the Interior Mr. Rashid Nurgaliev has approved the instruction on licensing and controlling activities of private security enterprises and detective agencies, which stipulated the procedure of registering the PSEs, organizing control over its operation and regulated private security-detective activity in the country. For example, in accordance with the order, agreeing statute of a security service of a legal entity with police should last not longer than for a month. In case authorized agency does not make the license in course of 30 days not giving clear explanation, the side which has submitted the documents has the right to address court. In the document there were given all the details of registering and storing weapons in private security structures, às well as its use of special facilities in PSEs and detective agencies.
Nevertheless a year later the Ministry of the Interior has proposed to the government to set up effective control over private detective activity in order to prevent violation of constitutional rights of citizens. And special attention was paid by Mr. Nurgaliev’s department not just to reinforcing criminal and administrative responsibility, but also to prevent misuse of results of operative-detective activity and to forbid non-sanctioned use of information about a client by private structures. Although the draft bill restricts participation of foreigners in setting up and managing private security structures in any form, security companies keep the right to receive credits in banks with presence of foreign capital.

As the correspondent of the "Rossiyskaya Gazeta" was told in the Ministry of the Interior, the government had sound grounds for reinforcing control over private security and detective agencies. And especially regarding forbidding activities of foreign security structures at the territory of Russia. Fortunately, none of such enterprises has settled down in our country. But there were attempts.
For example, as the "RG" sources in the Ministry of the Interior reported, the largest holdings Securitas and Group 4 Securicor have demonstrated their aspiration to operate in our country. These holdings have already practically divided between themselves the security services’ market in Scandinavia, the Baltics and other regions of the world. Total personnel of just Group 4 Securicor international security holding exceeds 350 thousand people. Using mergers and acquisitions the holding has got subsidiaries in 110 countries.
What is unpleasant is that there were noted persistent steps in using security structures for gaining access to strategic information.
Another reason given by the Ministry of the Interior to justify that strict steps – protection of citizens’ private lives from eyes of outsiders. The problem is that private detectives often organize illegal shadowing and eavesdropping of people. Ànd sometimes even intrude their homes, search it and even detain people. Even installing a video camera in a shop without warning customers about it is illegal.
Òhe same is with sealing bags, inspection on exit and other. A guard may only detain a thief if there exists a clear picture of theft. Ànd all the rest is police business.
In the opinion of the Ministry of the Interior more strict licensing and registering regulations for PSEs were required because about 10 per cent of private security enterprises exist on paper only. Including cases of PSEs being set up for legalizing carrying weapons, money laundering or as "reserve landing ground" – if some company is closed by authorities.
"RG" information
There are more than 23 thousand private security enterprises and about 4 thousand security services registered by police in Russia. They protect about 250 thousand sites. Total number of personnel- 740 thousand people.
The PSEs are armed with 119 thousand firearms. Out of these – 83.7 thousand pistols. In 5 years the number of security enterprises has doubled. In half a year there were found 38 thousand different violations including weapons’ use regulations and violations of constitutional rights of citizens, licenses were revoked from 740 enterprises. 17 thousand persons were drawn to criminal and administrative responsibility, 22 thousand persons were deprived of the right to practice private detective activities. Within five years there were registered 800 cases of private guards participating in "black raids".
